What Kinds of Things Can Copyright Registration Protect?

In the following situations, the aforementioned documents are necessary for copyright registration:

1). Creative/Artistic work

  • 2 copies of the work, with a DD/IPO of Rs. (as appropriate) per copy.
  • If the applicant is different from the author, a NOC must be provided.
  • If the work is published and the publisher is not the applicant, a NOC must be provided.
  • If the work is being used on or is capable of being used on goods, search for a Trade Mark Office Certificate (TM-60).
  • NOC from the subject whose image is on the piece.
  • A specific Power of Attorney in original form, duly signed by the applicant and acknowledged by the attorney, if the application is being submitted through an attorney.

2). Cinematograph Film

  • 2 copies of the work, with a DD/IPO of Rs. (as appropriate) per copy.
  • A NOC or a copy of the contract from numerous owners of the rights (deed of assignment).
  • If the applicant’s work has been published by a separate publication, then the publisher must provide a NOC.
  • A specific Power of Attorney in original form, duly signed by the applicant and acknowledged by the attorney, if the application is being submitted through an attorney.

3). Music

  • 2 copies of the work for music, with a DD/IPO of Rs. (as applicable) per work.
  • If the work is published and the publisher is not the applicant, a NOC must be provided.
  • If the applicant is someone other than the author, they must provide a NOC.
  • A specific Power of Attorney in original form, duly signed by the applicant and acknowledged by the attorney, must be submitted if the application is being submitted through an attorney.

4). Dramatic/Literary

  • 2 copies of the work, with a DD/IPO of Rs. (as appropriate) per copy.
  • If the applicant is someone other than the author, they must provide a NOC.
  • A specific Power of Attorney in original form, duly signed by the applicant and acknowledged by the attorney, if the application is being submitted through an attorney.

5). Sound recordings

  • 2 copies of the work, with a DD/IPO of Rs. per work (as appropriate).
  • A NOC or a copy of the contract from numerous owners of the rights (deed of assignment).
  • If the applicant’s work has been published by a separate publication, then the publisher must provide a NOC.
  • A specific Power of Attorney in original form, duly signed by the applicant and acknowledged by the attorney, if the application is being submitted through an attorney.

Copyright Registration Process

To register for copyright, the following actions must be taken:

User Authentication: User registration on the official website is the initial step in copyright registration. The user will receive a login ID and password following successful registration.

Application for Copyright Registration: According to the first schedule of the rules, a copyright registration application is submitted in Form XIV along with the fee specified in the second schedule of the rules. The candidate must sign this application. If necessary, a power of attorney must be enclosed and must be signed by the party and acknowledged by the attorney.

Submission: You will receive a dairy number once the application is filed with the required documentation (acknowledgment).

Certificate of Copyright Registration: If the application is accepted, the authority will issue the registration certificate. Normally, the entire process takes between two and three months.
